Can a collection angency garnish a social security check?
I have a collection agency saying they have a court ordered judgment from back in 2000. I have worked up until 2006 when I had a heart attack and became disabled I receive social security not SSI. Can they garnish this?

- A collection agency can't garnish anything. They have no such power. Tell them to get bent.
- Not if it is for disability. They can only take income after a court order. It rarely happens unless you owe a ton of money. If you know you owe them just pay them off as you can. Don't let them threaten you. Sometimes they claim to be a sheriff or from a department of that nature. But local authorities have no jurisdiction with this stuff.
- They can, with legitimate reasoning submitted to the SS Office, if approved, they may remove some or all of your SSI check is it SSDI or SSI?
- No, but you can be court ordered to make payments. SSI payments can only be garnished for 5 reasons. 4 are taxes and the last one is Child Support.
